Lottery System for H1B Visa
The lottery system for H1B visa was introduced in the year 2007. The US immigration service started the use of computers to randomly pick visa recipients from the total number of H1B visa applications received. In fact it was due huge amount of H1B visa applications that the USCIS had to put out an edict for a lottery type system
The lottery system was introduced to sort out the lucky candidates from the unlucky ones but according to some of the industry experts this move has affected a lot of employers. This lottery system came into use for rejecting H1B applications so as not to go beyond the 65,000 quota mandate.
But according to many it may affect the quality of talent because due to this lottery system, some of the deserving candidates might be left behind and some of the less deserving candidates might get the visa.
There are few tips from Jacob Sapochnick who is recognized as one of the most innovative and upcoming Immigration Lawyers in the US, which are as follows:
1. Ensure that all documentation is submitted in your petition
2. Do your petition in a timely manner (I agree and see no reason why April 1 should not be your goal in most circumstances)
3. Ensure it is sent to the correct USCIS adjudication centre for your region
Some of the experts in this area also suggest that the candidates should go for the H1B premium filing system. In case you have means to pay for premium processing or if your prospective H1B employer sponsor is ready to do it on your behalf then it is better you go for it. The H1B premium filing is where the USCIS guarantees a response of approval, denial or need for more information within 15 days of filing. But this route costs an additional amount of $1,000.
